ICO warning to businesses to securely encrypt data

London based loans company, Jala Transport, have been fined £5,000 by the ICO for not properly encrypting its data. The ICO is encouraging small businesses to treat this as a warning that they must ensure that any data which could “cause clear damage and distress to the customers affected” be properly protected. Jala Transport lost an unencrypted hard drive containing 250 customers’ data which included names, addresses and financial information. The hard drive was inside a briefcase alongside £3,600 cash and other business documents which was stolen from the business owner’s car.

Initially the ICO enforced a fine of £70,000 but due to the financial state of the business and the fact that the breach was voluntarily reported, the fine has been lowered. Had the data stored been securely encrypted, the loss of this data would not have left customers exposed to potential identity thefts and the company would not have been in breach of the Data Protection Act.
