Facebook faces lawsuit over data allegations

A lawsuit has been brought against Facebook for allegedly intercepting private messages and selling the data to third parties. The claimants accuse Facebook of scanning URL’s sent within private messages for “purposes including but not limited to data mining and user profiling” and selling the web activity to data aggregators, advertisers and other third parties.  If found guilty, this is a clear breach of the Electronic Communications Privacy Act and the Data Protection Act.

Representing to users that the content of Facebook messages is “private” creates an especially profitable opportunity for Facebook, because users who believe they are communicating on a service free from surveillance are likely to reveal facts about themselves that they would not reveal had they known the content was being monitored. Thus, Facebook has positioned itself to acquire pieces of the users’ profiles that are likely unavailable to other data aggregators.”

Facebook has retaliated saying “we believe the allegations are without merit and will defend ourselves vigorously”.  We will follow this story and bring more information on how it progresses; should Facebook be found guilty it could result in loss of £millions for the business. The Data Protection Act protects the privacy rights of individuals and failure to adhere to these results in substantial fines and even criminal prosecutions.
